Has any one had issues with their Toyota Verso ?

I recently was nearly killed after the Verso failed to pull up on a motorway slip road, I had to swerve of the road and crashed into a tree, Toyota GB have denied any responsibility, as the car was so badly damaged they could not get to the engine management system to analysis if it had a fault, they have said due to this therefore they have to assume there was no problem, well as they can not access the system I have to assume that there was, also none of the safety systems worked to which they have told me I did not hit the tree hard enough to create enough g force to activate the airbags or seat belt restraints ????

I am waiting for the engineer report but could do with advice on how to go forward ?? has any one else had this problem ??
