Auto Transmission Whining

When I was buing my Rav4 2008 (77 k done) I have heard some kind of whining from transmision (i think its transmission not diff) during the test drive. Obviously I said to salesman about it and he said that its NOTHING and don't worry obout it. It was main dealer, they gave me 2 years warranty. Nonetheless I bought the car. I did 700 miles since and everything is fine apart from this whining. I can hear it at about exactly at 25 mph and it disappears at 30 mph. The faster I drive the whining disappears because of higher RPM - I can hear it at 40 mph as well but sound is very quiet. Should I worry because of that? In addition the transmission oil is not crystal clear. Its a little bit murky.

Don't trust the salesman.

Take it back to the dealer and ask them to investigate.
