Just been thinking about this as a colleague of mine had been hit in her car due to a car that could not stop due to ice going down a hill. It hit the side of the car so hard its affected the suspension and steering.

How would the insurance company portion blame in this circumstance?

Take it the car that couldn't stop (car a]) hit your colleague's car (car b]) on the side? On the face of it, it sounds like it is a fault accident for the owner of car a].

Were there any independent witnesses?

Of course this doesn't prevent the possibility of your colleague losing some No Claims Discount - which you get/retain by not claiming, regardless of who was to blame.

If it is decided the other driver was at fault, your colleague's insurer will seek to recover costs from the third party's insurer.

It is also possible that the third party insurer, given the circumstances, may accept responsibility and offer to pay for the repairs to your colleague's car. In which case your colleague should make their own insurer aware of the accident/damage and also make the insurer aware, that as the third party's insurer has accepted responsibility and is repairing the car, that they are NOT making a claim.

yes she's reported the accident, she's off today having the garage look at it. I was thinking the third party insurer would pay out for her car; after all she was not at fault in anyway, just in the wrong place at the wrong time.

I was "lucky" last year when someone crashed into me. they admitted fault straight away. shame my car is in the garage for the third time as the garage made a right #@£/ of the job twice.

hopefully the other party will admit liability for your colleague
