Scaring A Scamming Git

HSBC are being :censor:. Theyve declined to refund me saying that it's not fraud if I willingly paid for something that i've not recieved.

eBay suggest getting the police involved, then taking the case to a small claims court. Before I go this route would a little scare tactic prove useful?

I came up with this...

As I have still not received the item from yourselves I ask for a FULL refund of £490 that was paid by me.

If the refund is not honoured in due time I shall proceed on legal grounds to reclaim lost monies. The police have already been informed as has my solicitor and they suggested this as an intitial alternate course to court proceedings.

Have you contacted Citizens Advice and/or Trading Standards. Usually the mention of either of these can do wonders.

Your letter seems OK to me. It's direct, but polite and gives them the chance to make amends and draw a line under the situation.

I'm not up on the law or anything, but perhaps say that if you do not respond of refund me my monies within so-and-so number of days then I shall have no choice but to inform the police and my solicitor to start court proceedings...

At least that was you are telling him thats what you WILL do, without implying you have which may backfire on you.....

I hope you get your money back soon anyway - have eBay deleted his account on there? I noticed he comes up as a non-registered user.....

tell him that if he does not give you the money within a resonable time limit then you will get solicitors and police envolved, but you must give him time to send the money back to you eg, within two weeks. I found this works for me. good luck , I know how this feels mate. :thumbsup:

Right mate, im in a similar position

April, i brought a V600 mobile phone from a ebayer. Phone never turned up, but i paid over £200 on paypal.

I have contacted paypal, and they cant refund the money as his account is empty.

Ok, so i contacted the police. They cannot assist as its not technically fraud. I paid for something, but according to some law, he is NOT in breatch of contract.

Ok, so i contacted the Trading Standards. They will not help as its a small value and im the only person.

Then i contacted the citizens advice bureau, again they reiterated the law to me, and said that they cannot do anything.

I have two options

1) Take him to a small claims court, which costs money. I have been warned that he can get out of it by quoting loads of law, which there is a loophole. So i could stand to be out of pocket by more 100's in legal costs

2) second option is to travel to Sunderland and give me a little tickle which my golf clubs and baseball bat that travels with me in the back of car. Problem here is that id end up in jail

Surely eBay should provide protection for users so people cant do this to them after they have taken their money..... :ffs:

yes eBay provide an insurance service, amx claim is £105, thats all u get back.

Basically eBay and paypal are con artists when it comes to fraud

What was the name again and I'll make some enquiries with our Boro branch, see if they've had dealings etc. He might even be a customer :eek: Either way couple of the lads down there are good mates so they'll look into it for me :thumbsup:

get a crew and go chat with him, hell be scared as an F-word if hes scamming you, or hell explain the situation if hes legit.

One question all have you tried sending letters to his house.

theres been loads of ebayers iv dealt with that cant be ****d to use emails or have problems with it.

Coz iv been peed off before and sent loads of emails and that, but id still get my item... (would be nice to let you know thou dammit) and about 5 week later ill get an email saying - "congratulations, you have won my item blah bklah" :ffs:
