I think the CSW 10%+3  is so the recipient of a letter will remember they were well over the limit. 

At 31 people would be inclined to argue that 'I can't drive safely if I am starring at my speedo. 

I would add that I find it far easier to engage the CC at the limit where the road is clear, or the limiter where the traffic is heavier and fast.

Yes, good point, I think you've got something there. If you get clocked doing 38 in a 30 there is no argument.
