I have noticed that the rear hatch is difficult to secure. When I reported this to my dealer, they reported that the latch was bent, and that Toyota will not repair/replace under warranty.  BTW this was done at the first 5,000 maintenance visit to the dealer.

The car has not been in any accidents, I have not modified or done anything to the hatch but open and close. Why would Toyota not provide any warranty repair?

Presume the issue is not considered to be a manufacturing fault. The warranty seems to differ in the US (where you are) to the UK (where Toyota Owners Club is based).

Hi Robert,there are a couple of reasons why Toyota might deny warranty repair for a bent latch even though your car is new and hasn't been in any accidents.

Car warranties typically don't cover damage caused by misuse. This can be a tricky area, but if the dealer believes the latch was bent due to improper closing (slamming it shut too hard, for example), they might deny warranty coverage.Another possibility is that the dealer suspects an external factor caused the bend. This could be something like debris getting lodged in the latch mechanism or someone forcing the hatch shut.

Talk to the service manager explain the situation calmly and reiterate that the car is new and hasn't been in any accidents. Ask them to explain why they believe the warranty doesn't apply. The warranty manual will detail what is and isn't covered. Look for sections on latches, doors, and general exclusions.

If you're not satisfied with the dealer's explanation, you can contact Toyota customer service and explain the situation.
