Ok -

Moved my car onto the drive yesterday to wash it :rolleyes: & left my dads in the road, half way through I heard a metal thud :o , turned around & a neighbours maoosive Rover had rolled down the road without the handbrake on and smashed into his car... :unsure:

Could have quite easily been mine :unsure: - but does anyone know what the legal implications are as technically there wasn't anyone driving :wacko:

They are sorting it without insurance companies as it looks like all it needs is a new wing & its only a high milage diesel Fiesta - it did hit the wheel tho so i'm hoping it hasn't mullered the wheel bearing or anything... :blink:

Any ideas? :)

If the owner left the handbrake off then it's negligence. Your win.

If the handbrake was faulty the same story.

There shouldn't be a problem, then again we are talking bout insurance companies.

Similar thing happened to me a few years back, parked in the pub, handbrake failed and roled into another car, my fault entirely.

As said in previous post you have full right to claim if the guy doesn'f cough up all that you feel is needed to get the car sorted to satisfaction
