:censor: You really have to be extra careful about the dealers. In my case I found out that although my MPV cost me about £400 more because of the warranty (included in the price), it did not mean anything. The dealer which I am not giving his details yet (but in North East of London so be extra careful) told me that it almost covers nothing and he was not helpful all the way through. Real pain basically!

I advise you to check what the warranty covers. You also check the personality of the dealer. It may seem all superb at the beginning however as soon as the money is paid he is some one else.

It cost me hours of call and many bitter conversations. In the end I found out that most of the car was faulty. I took it to Toyota dealer to prove and it has been documented how on earth it has ever past the MOT! Link bar was missing, the break disks and pads were faulty, baggie repaired exhaust etc, faulty tyres, damaged seat belt etc. My air conditioning units were missing it has been a year and they still have to be delivered. After 2-month shock absorbers failed, steering wheel is shaking, sliding door stopped operating. Every call I made from my expense and the every time I had been insulted. Either shutting the phone on the face or telling me will call you back which never happened.

I could easily say that there were at least 100 calls made from my mobile. Now I am still waiting for my air con units!!! Sock absorbers will cost me at least £200, exhaust £150, tyres £300, sliding door I don’t know.

The long story short asks your dealer exactly what is on the package and make sure everything is written down. Thanks to God that at least I made some bargain at the beginning so that now I can cover some of the costs. After all it was not a bargain and added insult to the injury car needed lot of care.

I will reveal his name and business very soon which he appears to be flourishing from his dirty business deals and moved to the new site with a central location. I am giving him a one last chance in order to clear his name. All I can say that stay away from North-East of London for the time being.

I recommend that we should reveal the dirty traders on this site as well as www.estimaownersclub.com and protect our members. What do you think? I certainly could have benefited. We should reveal them in person and remind our members about what to look for before throwing away thousands of pounds.

Sounds like you have had some real bad luck there mate.

There was talk a while ago of including a garage review section but I don't remember what happened to that.

You could post in the website suggestions section and see what the managements response is to that.

It may be worth checking prices on www.bbcspares.com as i have found them very reasonable and specialise in new and second hand parts for the Estima/Lucida.

Sorry to here about all your problems and hope you can get them sorted at not too great an expense. I wonder whether it is worth talking to the Citizens advice to see if you have a case under the Sale of Goods Act.

its nothing to do with citizens advice ,if you think you been missold and the MOT's been creative then its a matter for the police, end of story. get a wriiten statment of the MOT failure and sue the guy who sold you it. either way stop moaning .

andygodwin, I am not moaning. What happened has happened. However I can not accept the fact that this guy will get away what he has done. I am simply trying to warn other members about what goes on as well. It is about thousand of pound of lost. I also appreciate Gareth

for the advice on citizen advice bureau and police options.

Please accept my gratitude for your helps, which they are proven to be useful as always.

Probably the Small Claims Court idea would be the best to go for. Do you know anything about the credit card payments. I was told by the DTI that Credit Company has the same responsibilities as the dealer. What should I do in this respect? I suppose writes to them and ask for help what do you think?

In the mean time everyone should be extra vigilant about the rogue traders.

Sorry to hear of your problems mate. I'm new here so hope I am doing this right. Anyway. I agree with you that these rogue dealers should have thier details made public. It is the only way they will be stopped.

Meanwhile. The small claims court idea can work in some cases but take care to read up on it properly. It is no longer the £10.00 simple answer that it once was. I am not up to speed on it at present so will not adbise further.

If you have all the legal paperwork for the vehicle you should have it all checked out by somebody in the know. If the MOT is false then as somebody else has mentioned, it is a matter for the police.

I can't see anywhere in you peice exactly how long you have had the vehicle but if it is less than a few months and you have experienced problems early on and tried to have them rectified by the dealer, you should simply reject the vehicle and demand a full refund. It would also be a good idea to have another machanic look it over and note all the faults in case the matter goes to court as would seem likely from the sound of it. If the dealer acuses you of causing the damage you should be aware that the sale and supply of goods act has been amended and now states that the onus is on the dealer to prove that the goods were in working order when sold. I hope this helps.

you will need to get a mechanical engineers report done first before you go to any court, as this is what they wil ask you for first, so this is your first move as this evidence will stand up in court,

Hi,

I still have not been able to solve it. I have had the report from a local dealer which he does not accept and sent the matter to his lawyer. I suggested if he pays to Toyota Main Dealer I am prepared to take the car which he also refused. If he had nothing to worry he should have accepted happily. I can not afford a lawyer and do not know how much the court will cost. It is the last option which I am prepared therefore I am in a bit of stuck situation at the moment.

There are number of things can be done. Naming and shaming him on this site which I am going to do now.

Make demonstration in front of his show room so that it will give a chance to possible customers about his rogue dealership.

Take him to court. I don’t know how at this moment in time and how much will it cost.

BBC Watchdog programme has contacted me on this issue. Let’s see how far they can take it.
