Pot Holes!

I was happily driving down a country lane near my house the other day whistling along to myself then all of sudden ' BANG!' I'd driven down the biggest mutha clucking pot hole i'd ever seen in my short life.

I thought all was fine until the morning. I woke up and saw my tyre was flat. I just figured i'd managed to burst it when i went down the hole. Took the car to Just Tyres and they took the wheel off. To my horror the whole alloy was bent from side to side and a huge dent was left in it too. Phoned the place where i bought my wheels from and have been quoted just short of £160 for a new alloy and tyre. As you can imagine, i'm very, very p**sed off!

Anyways, i guess what i'm after now is what to do next. The man in the tyre shop suggested taking a photo of the hole and sending it to the council. Will it work!?

yes, should be able to claim for the lot on the council, happened to my mate driving his mini a while back.

You may also want to get toyota to check that your tie bars etc aren't bent as well ;)

Get you backside back to the hole.... Take pictures of hole, take pictures of hole with a ruler in it, with the wheel next to it if you can, and other things to show size. Then try and get some other people driving by to say it's dangerous and costly.

Make sure you time stamp your pics so the council don't sneak behind your back and fill it in before you tell them.

Then send them a letter explaining your problem with the photo's (make copies if you can... council could lose them) If they refuse... you can sue them trhough the small claims court and 80% of the time if you have good evidence, you're sure to win!

Hope it all works out, and yes... pot holes are horrid things!!!

To get a claim from the council, you first have to proove that they knew about the hole, you could proove this if the hole has yellow markings painted around it (the council plan to repair it), if the council claim they didn't know about it, then it's possible that they will deny responsiblity.If you, or anyone you now uses the road on a regular basis, and knew the hole excisted, then it's probable that the council did too, get the names of people who use the road , and knew about the hole, to use as witnesses.

Remember, Scottish law could be different from where you are.

Failing that buy some yellow spray then take the picture :D

If people could claim for damages to wheels from pot holes here, all the local councils would be bankrupt! :lol:

If the pot holes as bad as it sounds though, then I imagine the council WILL know about it.... however I guess they could still lie through their teeth and deny all knowledge!

Hope you get it sorted soon anyway - keep us updated on what goes on!

Some around my area, about 3 deep onces within a metre of each other. Noticed they are filled in today! Which is good.

Good luck with it, even if you don't get anywhere with it in the long run, it is definately worth having a go at claiming..if you dont try it you wont know

Thats very true Blue! Taking the photo's tomorrow and getting me old man too write me a letter (he can word it better than i ever could!)!!! Wish me luck!
