Auto Stalling Again

I've got an Automatic 03 T-Spirit, it's got the stalling problem that a few people here seem to have noticed. Now my car is 3 years and 5 months old and therefore out of Warranty, however in Janurary when I left it in to be serviced I mentioned to them that it was stalling and they said they would have a look. When I picked it up they said it was fine and couldn't find a problem and knew nothing of other Autos stalling. From RunBoys post it looks like the problem is the ECU and to quote

Eventually my dealer found a Toyota fault report saying the ECU was to blame

I'm leaving my car in for it's 4th service tomorrow and would like to know, if my problem is the ECU can I get it done FOC by Toyota because a) I mentioned this to them when it was within warranty, and B ) This is not a wear and tear issue, it's obviously a fault and therefore covered by sale of goods act - fit for purpose.

Also, if I mention to them that this is a know fault, and they claim they know nothing about this, is there somewhere I can point them to to see this "Toyota Fault Report"

As its booked in for a service tomorrow, if anyone can update me ASAP I would appreciate it.

My dealer, after having the car on previous occasions to look at the fault eventually said there was a technical service bulletin for the auto stalling problem which could be solved by replacing the ECU.

If it's a known issue that would have been present when the car was made I see no reason why Toyota shouldn't replace the ECU for free, even if you are outside of the warranty.

Trading Standards will tell you that just because a warranty expires you should still have goods with a "reasonable" life-you wouldn't expect to pay £700 for a washing machine that broke down on day 357 after purchase.

What would happen if you had an accident due to your car stalling, when all along Toyota knew how to fix the problem?

OK, picked up my car after service yesterday, they said they had looked for a technical bulletin regarding the auto stalling and hadn't seen anything, they said they would contact Toyota (presumably head office) today and speak to their technical people and see what they say, and call me back, so I'll wait and see if I get a call from them.

Hi, legal precedent was apparently set in early 80's when British Leyland failed to long term repair the rear suspension of a 1500 Spitfire throughout the warranty period. The fault showed up again after the warranty period expired and the owner apparently sued them successfully for the cost of the repair as they hadn't effected a suitable repair first time around.

Providing you have proof that you asked Toyota to look at it (is your request or their response documented on the service sheet ?) AND you can provide proof of existence of the technical bulletin then they should roll over nicely. Trading standards won't however take any action until you have undergone the Toyota complaints procedure and have reached an impass.

And the problem has never come back since the replacement ECU was fitted so it solved the problem.

My dealer certainly found something about it from Toyota. If you get any problems, give my dealer, Dingles Toyota, Norwich a call and ask them if they can remember what TSB it was.

They haven't called me back yet so I might give them a call tomorrow, however I might call Dingles first. Can you remember when you had it done as it might help them locate the info if they know when they had to do it for you.
