If any one remembers my previous posts about having trouble with my second hand t-sport I bought from one of my local toyota dealership, well i'm still having trouble.

I had the work done under warranty, and after sorting the previous problems out, I now have a few new ones.

I'm not going to say what they are at this time as one or two members work at the garage, but I am heading down to the dealers on friday. I can't afford any more time off work, and I don't want some of the problems to return after my warranty is up in just over 18 months time, as that would be expensive, and I don't want them to cause new problems like they have or miss some of the problems as they also have done (even though they had all the problems written down by myself and handed to them)

Any one know if I am within my right to ask for a new car. If I knew toyota did a 30 day exchange plan, and if I found all of the problems before the 30 days I would have had a new one then.

Its hard enough getting a new car when you buy brand new, let alone when you buy second hand....

You can ask I suppose, but they could argue they are all things that can be sorted under warranty - its only if its the same problem repeatedly again and again that you stand a chance of maybe getting somewhere - there are new problems and they will probably just say they will repair rather than replace.

You would need an amazing case for them to turn around and give you a replacement T-Sport....

I know you've had a lot of problems mate, but I really doubt they will do it. You can ask of course, but I seriously doubt they will give you a new car over this, especially if they are problems covered by warranty and they aren't repeated problems. :unsure:

Hey dude just thought I would let you know as I'm kinda in the same boat ;) !

Only had my car 3-4 months and it's been in about 7-8 times and is going in again on tuesday - clutch again

So I phoned up HQ and told then my problems, they said that they wouldn't do anything (compensation etc) as the work is being done under warranty.

When the guy called me back I drilled it into him that it wasnt the fact of the work being done it was the finding the time/time of work etc, but still nothing.

If the same problems still aren't sorted in a months time i'm getting on to them again and if they won't do nothing - trading standards it is :ffs: :thumbsup: !

The best thing is I haven't had to wash my car as they have done it every three weeks and everybody in the street must think that I work for Toyoto - so far I have had aygo sport*2, aygo diesel, old yaris 1l, new yaris 1l red, new yaris 1l blue T3- wonder what i'll get on Tuesday :)

Some may remember the sorry list of faults and niggles when I bought my car new from Toyota. I was starting to want a replacement too!

As I see it, as long as they keep repairing it under warranty, they are fulfilling their obligations. Sorry mate but I don't think you'd get far requesting a new one.

I'd be happy to be proved wrong though I've not hear of it happening to anyone before. You really would need to get legal advice for something like this in my opinion.

You know what we all need in place.. A LEMON LAW like they have in the good old USof A.. they get so many chances to repair a recurring fault, if it continues to be faulty you can reject it as a Lemon and get it replaced.. and it doesn't just cover cars.. just about everything is covered.

You know what we all need in place.. A LEMON LAW like they have in the good old USof A.. they get so many chances to repair a recurring fault, if it continues to be faulty you can reject it as a Lemon and get it replaced.. and it doesn't just cover cars.. just about everything is covered.

But as you say Davy, the Lemon Law covers reoccuring faults.... armoredfist is talking about more new problems with the car...

How long have you had the car now mate? And how many faults in that time?

8th of June i've had the car since

number of faults' haven't really counted but it's about 15

worst one is they changed the cv boot joints and driveshafts and now it's causing the car to pull to the left, and i've already caught the kerb twice, whilst driving about 50MPH it's &#33;Removed&#33; dangerous, to be honest I shouldn't be driving the car with it like that.

Wonder how that would stand up if I got legal advice.

I think that the fact that it has been in an accident and had a shoddy repair job should give you some good grounds to stand on :thumbsup: !

I think there are two different types of claims - one for shoddy repair work, and the other for a part failing :unsure:

At the end of the day forget Lemon Laws etc, the car has been in a bad smash. It was repaired badly and the previous owner dropped it like a hot potato.

I recommend you do the same.

Part ex it as soon as possible, it will never be right again.

Fifteen faults since June? Those are the ones you know about.

There should be a massive Red Flag waving in your brain mate, it’s dangerous, don’t take your family out in it and don’t expect it to look after you if you are in a smash.

Put it down to experience and get rid!

I also dont think you would be able to get a new one, it does sound extremely worrying especially to be pulling to the left like that and at such speeds too......a lot of companies just want to take all they can and give sod all back :ffs:

Well I got my replacement car, just about

They wouldn't swap it for a new one, as the problems were repairable, and there were a few other things he said about why they can't replace it.

Two options,

1. Is to have it repaired but I don't trust them enough to actually repair it to what it should be, and I could still have problems once it's repaired.

2. One of the salesmen who used to work in the other dealers who sold me my 1.3 is selling his, so toyota are buying his car off him and that car is my replacement,

Decided on option 2, I will be going to look over it tomorrow, anything has got to be better than what i've got now.

That does sound like a pretty fair deal and as good as could realistically be expected - as long as the salesman's car is kosher. The dealership will doubtless dispose of your through the next auction "as seen" and then it will be someone else's problem...

Sounds like a reasonable result as long as the next car is a "good" one.

Can you take someone technically qualified with you to look it over?

When you have swapped cars maybe it would be a good idea to post up the offending cars registration number (or a photo showing the plate) on here so that our members do not end up with your old problem

Just come back from seeing it, much better than mine, it's a 2004 with 20,000 miles.

Mint condition.

Because they now know the condition of the car, they cannot put it back on the forecourt, one of the mechanics is having it and rapairing it himself.

and also, when the car was being repaired it was resprayed (bonnet bumper and wings) I also had the car bumpers colour coded, but due to the fact the spray job was rubbish (not toyotas fault, the company toyota use) I'm having that payed back, which was more than I was hoping I would get.

All in all, they sold me a dodgy car, but now i'm getting a better one.

All I can say is they have good customer care, should have spoken to him first time around rather than the other bloke I saw.
