Hi everyone!

the letter...... well lets just say it annoyed me even more!

it was just short and sweet saying 'further to your correspondance 1st Feb' (SOUNDS LIKE THEY ARE NOT ACKNOLEDGING MY FIRST LETTER :-] )

Basically they are forwarding my correspondance to different part of the toyota team at a different country (still in the UK) to deal with!

5 weeks tomoz that toyota have had my car!

Right the letter in response to mine came this morning.. bad news folks.

it said sorry for the trouble blah blah blah. We are aware that the dealelership has offered window tints as some compensation blah blah and that they are not going to refund me or replace my car with a new one on this occassion!

what am i going to do?

please can someone advise me. I am so sorry to keep going on i really am but i can't have that car back i would never have peace of mind. I am not saying this for sympathy BUT i suffer panic attacks and if i have that car back i most likley will be nervous evry time i step foot in it worrying about the what ifs. I had panic attacks while i was driving in my previous car and on some ocassions i have to slam my brakes on to stop as i hyperventalate.

i am feeling really sad :-(

Relax and enjoy your driving again. In all probability when you get your car back it will be fine and you will have years of happy motoring. :thumbsup:

Yeah just don't accelerate too quick :!Removed!:

As a last resort you could use my tactic, after 3 months of backwards and forwards with the honda they finally took it back off me........mind I did tell him I was going to drive it through his showroom window. I'll treasure forever the look on his face as he looked from my face to the gleaming S2000 and realised I wasn't joking.

If you really don't want to drive it annymore sell it.

But IMHO you're overreacting. If you get the car back

WITH a new engine annd it behaves the same AGAIN,

then there's reason to panic, but in that case there's

quite obviously something VERY wrong, which makes

your bargaining positions MUCH different...

But as for now; just phone 'm EVERY DAY untill

they're so fed up they'll actually DO SOMETHING...

And no matter what, do not pay for the courtesy car.

If they want to bill you for that, send THEM the

tax-bill for the time they've had your car...

i just dunno what my rights are but i will have a long hard think cus as you say my car should be fine when i get it back.

***UPDATE***

just been to citizens advice and they have assured me that i am entitled to a refund or a replacement!!! yipee!

it depends how far i am willing to take it though, someone she knew was in a similar problem and she had to threaten the dearlership to court before they really did anything!

Guys its the principle of things now thats getting to me 5 weeks and counting to investigate what caused my engine to blow--- as if!!!

i just hope i am doing the right thing?!?!

one of you guys (sorry i have forgot who) said about REJECTING the car and sales good act of 1979 WELL THANK YOU!! you are spot on thats exactly what i have been told to say!

if anyones interested shall i keep you posted!?!??

REJECTING FAULTY GOODS

Dear Sir/Madam Date:

REF: Toyota Aygo Registration number XXXXXXXX

On 1st XXXXX 2006, I bought a XYZ car from your XXXXX branch. Now, XX days/weeks after purchase, the car is defective.

You have had my car now for X amount of weeks and there seems to be no solution to the original problem.

The Sale of Goods Act 1979 (as amended) requires you to supply goods of a satisfactory quality. As you have had more than a reasonable amount of time to repair my car and the times you stated that it would be ready and it wasn’t I am requesting a full refund to include the optional extras I purchased.

Therefore, I am notifying you that I am rejecting the goods on the basis of your breach of contract, and request a full refund of my money (or NEW car) within 14 days of the date of this letter.

Yours faithfully, etc

make sure you write to the correct company address

include copies (not originals) of any supporting documentation, such as receipts or other proofs of purchase; order forms; invoices etc

quote any relevant account/customer/invoice numbers

be specific and stick to the point - quote dates of events, and all the relevant circumstances surrounding your complaint

be clear about what you want Toyota to do to solve your complaint

set a deadline by which time you want the matter to be sorted out and stick to this deadline

get evidence to support your claim, i.e. independent technical reports, and enclose a copy with your letter

keep a copy of your letters, and send them by recorded delivery

act quickly - delaying can sometimes affect your rights

be persistent - write a reminder letter if you don't get a reply to your first one

Emails get deleted and it’s hard to prove it was sent.

In writing is best practice (legally)

You can always follow it up in writing and send it Recorded Delivery (that’s my advice)... and do it TODAY :yes:

Judging by their response so far, I wouldn’t hold my breath!

This is why it’s time to up your game. They have had more than a reasonable time to put things right. You are being led on a merry dance so now you want definitive action, which is A Refund!

Time to get official and legal and show them you mean what you say.

Remember the law of the land is on YOUR side. You haven’t done anything wrong! So now its time to flex your muscles and get this sorted within 14 days.

you seem very clued up. You had bad experience?

it seems that if i take it all the way i.e solicitors it would cost a fortune and i would be so much out of pocket.

It shouldn’t go as far as to the courts. Seeing as you are in the right, if it did go that far costs would be paid by Toyota.

Remember you are the victim here, the law is there to protect you from this outrageous treatment you have received.

Get that letter to them now!

Hi guys well i rang up toyota dealership monday further to my letter and i spoke to the chap i always speak to. and before i could blurt out what i wanted to say, he said 'good news you car is being built up as we speak' and i just blurted out 'well im not having it back'. i explained myself to him and he said the aftersales who deals with that is in wednesday as in yesterday, he will call me and guess what ...... no friggin call!

i have a good mind not to have a replacement car just have the money back and get a little clio again.

****update****

Well after last week that toyota never rang me wednesday, i rang up thursday and i was promised a call friday----guess what ? no call again!!!!! as you can see they are really messing me around. I rang them at 4.50pm and the guy i needed to speak to was out the office again! shocking!!!!

so in a mad rage, straight from work i drove to the dealership (i was in a right state cus i was meant to have gone to the gym, so i had drank a red bull- i was soooooooo hyper!) i got there at half 5 and talked to the sales manager for an hour.

I must say he is the nicest , most helpful and reasuring chap there! i had taken a copy letter of what i sent to toyota GB but they had already got a copy and a big file all about me!!! i cried twice :-( i didn't mean to but i was talking about my leather seats and parking bleepers so i was a bit upset.

well anyways, apparently it is not in my policy to reject the car! and i could part ex it in?!?!

they said that people in Belgium are involved in this now because this is the first time ever that this has happend to an aygo. I told him all my worries, saying i would drive that car if you paid me a grand to drive round the block! i would rather drive a metro i snapped. I made it clear i am never stepping foot in that car again because of my panic attacks , i will never be at ease in that car.

i also told him that i hate being in the courtesy car because of the £500 excess, he then offered to get it changed to my insurance and toyota would pay the cost, or 'heaven forbid i have an acident, i don't need to worry bout the £500' he assured me that he is really concerned about my confidence and faith in toyota and wants me to try and rebuild it. I think what he said about the £500 excess is great, its a really big weight off my shoulders!.

well he said he will call me today after he has talked with a guy a called SHIV, who by the way was in the offices friday but the chap i was talkin to wouldn't speak to him then because he is all bunged up with flu and didn't want to catch it~!!!

shall i keep you posted on what happens????

Red Bull gives you wings......................if you had wings you would not need your Aygo ;) :lol:

The law would allow you to reject your car........especially after how they have handled your case.

Keep up the pressure and do not be fobbed off :thumbsup:

I'm absolutely flabbergasted at how they're

treating you, please DO keep us posted.

You should take notes on EVERYTHING they've promised you (and haven't

followed up on), including who you spoke to and when exactly.

Having such a file is in your interest, should it

ever go into legal action (which I don't hope).

As for the car; at first I wouldn't be bothered with havng the car back,

but after the way they've handled your case my confidence in THEM

would be close to zero, thus the confidence in their engineering....

I'd still have an Aygo, just not that one. As for the accesories;

those can be put on another car; seats come out with 4 bolts,

installing the parkingbleeper requires removing the bumper,

so they can just swap bumpers.

well the sales manager who i spoke with friday said he would call today hopefully with a decision of whats gonna happen. i still don't get it cus a chap i spoke to last monday said it was being built up there and then but obviously he was chatting out his backside!

i am waiting anxiously for that call.

My dad thinks that i may have to get a solicitor invloved?!?! i just want this whole experience to end.

the funny thing was, when i bought my aygo my dad told me to wait till march for the 07 plate and i didn't want to wait that long- well in a couple of weeks the 07's will be out :-(

That's very true - if you were still happy to go with an Aygo after all this, then it should be the least that they can do as compensation to give you the new plate.

And that way you can have a defined cut off date - 1st March - done, sorted.

It all sounds horrible...car salesmen can be such :censor:

on friday i said ' i want the same one, everything just how mine is, can't you just replace it?'

and he said that i could part ex it in cus the vat stuff and value dropping and he blabbed on a bit. i only owned the car for three weeks and they reckon that they can only part ex it like trade mine in?!?!

still waiting for a call of toyota............

I can’t make my mind up which is more frustrating, the treatment from Toyota or the way you are handling this situation.

Sorry but I feel like shaking you by the shoulders, honestly!

Stop messing around, they have your car AND money. You are still being fobbed off by Toyota and you are putting up with it :ffs: WHY?

I wrote on here what you had to write (which it seems you have ignored) and the next move would be a Solicitors letter explaining the facts and what you want and what will happen if they don’t comply. It will let Toyota know that you mean (or meant) business and are prepared to ‘Go the distance’.

Now you are talking about getting a Rover?!

Give me strength :censor:

Do me a favour, DON’T keep us posted until you either have a new car (as in a new replacement) or you get your old one back, which I think you will end up with.

Definitely don’t tell me that you have bought a Rover ;)
