Hi guys, i own an 06 avensis d4d t3-x

I was rear ended on saturday, at first it looked like a replacement bumper, but on opening the boot it now will not close. It's like the back end has been displaced forwards about and inch and a half.

the gaps on either side of the hatch are now about half an inch each side.

I think it's pretty badly damaged structurally. The other party insurer is paying but when i asked my insurer legal team if i could get it done at a garage of my choice (toyota dealership obviously) they said i'd need to pay my insurance excess. Currenty they want to repair it at some no-name garage and the work is only insured for a year, which i think is terrible.

What will i do? Should i pay the excess, they said it should be recoverable from the other side at a later date.

You pay the insurance........ You decides where it goes. DO NOT fall into that claptrap that the insurers would have you believe, about having to take it to their repairer. YOU DONT HAVE TO. Get it to your dealer, they will get authority to do the work and you will have to pay your excess, however if it was not your fault, you can claim it back off the other party. Your dealer may also deal with a non fault accident recovery system, whereby your dealer repairs your car, but they also suit the other party for damages, excess etc, either way, get to your dealer and don't let your insurance company take it anywhere other than where you want it to go. It's your car, not the insurance companies (well not yet anyway) lol, Kingo :thumbsup:

Parts king is spot on with his advice and yes you will have to pay the excess which is on your policy but you will be able to claim this back with any uninsured losses(such as the cost of a hire car) if you were not at fault .

Does your policy have any legal expenses cover or uninsured losses cover to recover your loss if not many house insurance policies carry a free legal advise line

That's a good point, Mrs Kingo was knocked off her push bike by an idiot turning right, across her right of way. Bike was mangled, she only got a few cuts and bruises (nearly went through windscreen!) so I went to the solicitor to make sure we got her dues (new bike, time off work etc) He asked if we had any legal insurance, turns out I had it twice, and had paid for it, doh! It usually comes with House bricks and mortar, and contents insurance. I had two policies, take yer pick time. So check them out, and if you get no satisfaction from the third party insurance, suit them with your new found legal insurance, lol.

I've got legal insurance, they're dealing with the claim now. I changed the repair outlet to a toyota dealership. I just got a hire car delivered also.

I'll just pay the excess and claim it back.
