Service History

HI

new to this so please be gentle with me.

I very recently purchased a 03 TS3 D-4D. (Last Friday infact). I already had to return the car because I noticed one of the parking lights was'nt working and the screen had a long crack. I dont live local to the dealer in (Northants) and so returned the car. After a confusing discussion they finally guaranteed to replace the windscreen without me having to use my excess.

Since then I have noticed that the petrol tank at the filling end seems to be loose and moves about when I top up with fuel.

The clutch also seems quite heavy. Is this common? The main point of my topic is although I have a fully stamped up service book for the car. I dont have any indication of any work major/minor bieng carried out. Is there a way that I can get a full service history of the car from anywhere, is there a printout of work carried out kept anywhere?

There should be a phone number or name of the garage that carried out the services on the stamps in your service book, you could contact them and they should have it on record of any major work carried out.

I've just bought a 03 T3-X and I'm finding the clutch heavy too, apparently they are heavier on the avensis.

Any Toyota dealer has access to the warranty system and with your VIN will be able to see what parts have been replaced under warranty.

True, but because of data protection, you cant legally have a copy of it, the same goes for for service history. The service history belongs to the person that had it done, not to any subsequent owners. If the service book is left in the car, it is deemed to be part of the car and you get the history passed on, if it's stored electronicaly, then you cant get it (legally) unless you were the person that had it done. I don't make up the rules so don't shoot the messenger! :D

Had you thought of trying to contact the previous owner to ask some questions I am sure most people would not object .I think there name and address should be on the registration document as previous owner .

that is the line used by dealers - was covered on watchdog lately.

they can tell you anything about a car you want to buy or one you own, but usually pull the data protectin script out when they cant be bothered or dont want to put you off a sale.

I have managed to get a couple of the garages comply and still waiting for the other two to give the download. At the moment I dont have the log book as I've only just purchased the car from Simms of Northampton Got messed about today by the after sales team. They promised a few days ago that I would be having my car picked up today for a windscreen replacement. Did anyone turn-up. Did they :censor: so much for the aftersales bit!

just to put your mind at rest. the clutch is stiff. well on the ones i have driven it has been. might have something to do with the clutch being hydraulic????.

carnt help you with the petrol tank though. will check mine next time i fill it up.

if yours has the auto screen wipers make sure they put the sticky pad back properly that goes behind the mirror. if there is an air bubble the system wont work correctly. when i had my screen repaired through autowindscreen the toyota garage recommended me asking for a new pad thingy as wel. didnt have to bother in the end as they managed to fix the chip.

Very easy to make a flipant off the cuff remark like that, however, think of it this way

You are the owner of Car A, you are a very private person, Ex directory, dont have your name on the electoral role and keep yourself to yourself. You trade your car in to ABC Cars for a brand new one, you lost the service book. Then Chav B goes to ABC Cars and buys your old part exchange, wants to know if it has service history, Mr Green salesman says oh yes, we have it on our system, I will fill in a new book and you can have it. Chav B is happy and drives around until he hears a strange noise, finds the car low on oil and the engine now knocking, ABC cars say well it had a full history, and Chav B goes around to the previous owner of car A, giving him an ear blasting. Car A owner then reports dealer for a breach of data protection, ABC Cars get done for it!

Like I said, don't shoot the messenger, the point of this long winded reply is you cant just give people data from your computer system without good reason, it is easy to say "Oh well its data protection mate" and cover up the dodgy dealings of ABC Motors, and I would not put up with that sort of nonsense. What has to happen is we have to get permission from the owner of the service history (Owner of car A) and have his permission to pass on the service history. Now you might think that is a "cant be bothered, that old data protection script" but I'm afraid its the law

Now I'm not saying you cant get the history, you can, but there is a due process to follow, and for most it's too much trouble and they will just give the history to you, however, please be aware there are laws to protect peoples privacy and data

The data protection act covers personal data about living people.

It does not cover cars.

There fore is perfectly true to say it's complete rubbish to claim you cannot give out information about the work that has been carried out on a car.

What you cannot do is give out information from which personal data can be derived or identify the owner or there details . It is therefore valid to say that the clutch was repaired under warranty at 20K miles , it is not egal to day Mrs Jones had it done at 20K miles. It would also be equally invalid to say who owned the car between which dates or that the work was done by the last owner as their name is possibly still on a V5.

I've been in the IT industry from just after this law came in and it's amendments. It only applies to people not things. This act gets more abuse than just about any other I know and is excuse number one where the words "you know what , I can't be bothered " would be more useful.

And relax.

7.2 Information about objects or things

When considering the 'focus' of information it may be helpful to consider whether the information is being processed to record something about an individual or to record information about an object.

Example: Information may be recorded about the operation of a piece of machinery (say, a biscuit-making machine). If the information is recorded to monitor the efficiency of the machine, it is unlikely to be personal data (however, see 8 below). However, if the information is recorded to monitor the productivity of the employee who operates the machine (and his annual bonus depends on achieving a certain level of productivity), the information about the operation of the machine will be personal data about the individual employee who operates it.

Whether information is linked to an individual, for example, to learn something about that individual, is the key factor in determining whether information about an object (for example, a biscuit-making machine) is personal data.

Also, if the information has potential to be used to learn something about an individual, it may be personal data as discussed below.

Yep, as I said, it's only if the informatin about the thing can be linked to a person. You are 100% right in what you say. Service details about the car are not covered by the act if all they do is describe the things done to the thing.
