Avensis Clutch Replacement Under Warranty...advice?

Hi guys i have just found this forum...and wonder if anyone could advice on my situation!

I have a 2005 D4D with 52,000 miles bought 2nd hand from a Toyota dealer in Dublin 11 months ago (28,000miles when bought) its also still under Toyota Warranty for the next 3-4 months!

Anyway after reading posts regarding heavy pedal/judders/creaks / short clutch pedal etc i have experienced all of these....

When i bought this 11 months ago i noticed a heavy pedal, 1 month later this CREAK came in the clutch Pedal, i brought this to my Local Toyota dealer and they OILED it and all WAS FINE,

I left the car into Toyoata for a Service and again asked them to oil the clutch pedal as it was creaking again and heavy, 2 months ago i again left it into Toyato for another service and

again asked them to oil the pedal as it was AGIAN creaking and seemed even heavier...it was then i noticed judder when taking off in 1st... i went back to Toyota and notified them of this,

they done a technical report (which was drive the car around the block) and said that they would have the warranty guy have a look...

The result from TOYOTA IS THAT when "THE CLUTCH NEEDS REPLACING THEY will decide if anything is down to Manufacturing problem, or Driver error"

This clutch obviously needs attention yet i have to wait till it needs replacing, and all it seems at my cost..

Toyota Irl are telling me that clutches are not covered under warranty "if its driver error"

Driving is my living and i know how to drive a car and have never seen a clutch burnt out at 50,000 miles..........

where do you reckon i stand with this issue with TOYOTA..
