Avensis Constant Problems

I have an Avensis T2 D-4D (56 reg) Manual Diesel (1995c) with 23k on the clock.

In the space of a year i have encountered major problems with this car. Not wanting to bore people here with everything that has gone wrong (first month the dealer removed the oil pressure switch and could not find a replacement thus was off the road for over 5 weeks)

Since then it has been back for a variety of problems.

Straight to the point:

What are the chances of Toyota taking this car back and supplying me with a new one???

Are they bound to entertain such a point?

Am i legally able to pursue this matter with a solicitor to force the issue??

The bottom line is that the car that was sold to me is not fit for purpose.

And yes, its back with the dealer again as am experiencing a loss of power in first and second gears with plumes of black fumes coming from the exhaust.

Any such views as to legally where i stand and also Toyota's possible view point.

None, you didnt buy it off Toyota, you bought it from a Toyota dealer?

No, you will be asked to contact the dealer

Yes but the onus will be on you to prove that the goods were inherantly faulty because you have owned it for more than six months. My advice would be to speak to the dealer principle and give him a log of every visit you have made and what repairs were done, far better to come to an amicable agreement rather then throwing good money in the direction of a solictor
