Help I Think Ive Been Ripped Off With New Car

hi ive just recieved my new yaris 1.0 tr 2009 car and ive just noticed things arnt in the car which were described as being on it when i ordered it..

i was orginally going to buy a bog standard t2 version but the guys in the dealerships kept saying buy the tr version you get lots of extra things they then showed me a broschure and told me to check out there dealershipo website for info on it and the toyota website so i did..

i saw the main differences were the tr had air con/electric side mirrors/drivers seat that raised up /extra airbags/chrome air vents..and 15 " 8 spoke alloy wheels.

well i picked the car up 2 weeks ago and was really happy with it until i noticed that it hadnt got 6 Speakers which id be told it had its only got 4 and when ive read up its only on the 1.33 version which i wasnt informed about.

also the chrome airvents are missing..and most off all my car has the t2 wheels and covers not the alloys !!! i must admit i am clueless were cars are concerned and thought the wheels i had were alloys until my dad saw the wheels and said there not alloys there trims so i showed him the website which stated it had alloys and he told me to call them up.

i called them today and spoke to one guy who said yes all trs come with alloys and chrome airvents as standard but other things are on upgraded models i explained what id got he seemed shocked then said tghe sales man who sold me the car would contact me latter .he did call then said look what are you moaning about i knocked you alot of money off when you scrapped your car i said i appreciate that but ive got things missing ..he said look thats not my fault only trs made after september 2009 will have alloys he said theres a new model out then that has alloys as standard i said no theres not ive just seen 08/09 yaris trs in the street with the alloys i should have i want my alloys ..he laughed and said look what do you want from me?i said all i want are my wheels he said no chance if you want alloys there 500 pounds extra if you get the money ill give them to you but if not good bye then put the phone down on me !!

ive contacted trading standards this afternoon and theyve told me to find out exactlly whats missing from the 1.0 tr yaris 2009 and write to them and if they dont reply within 2 weeks theyll contact them but the advisor said its a clear case of breach of sales..he said if it was a second hand car the laws different but as its new they factory make them to order and your spec isnt the one youve ordered he also explained theres no time limit on when you buy your new car if the specs changed its wrong.

can anyone give me any help or advice on this please ..

Looking at Toyota Yaris Brochure (CBNGV-019YA-VB) Published February 2009

The 2009 Yaris TR 1.0 litre has:

Manual Air Conditioning

Electric Door Mirrors

Height Adjustable Drivers Seat

Extra Airbags

The Exclusive TR Cabin Trim is NOT FITTED on the 1.0 litre TR

The TR has 15 inch Steel Wheels with 185/60R15 tyres and plastic wheel caps.............Earlier versions had Alloy Wheels(These are now OPTIONAL EXTRAS)

The TR should have 6Speaker Radio/CD with ability to play MP3 and WMA CD..................are you absolutely sure there are only 4 Speakers?.........(The 6 Speakers are in each door, in the front dash,each side and a tweeter in each side of the front windsreen A frame)

Sorry to tell you that your car appears to be as described in the brochure...............The specification increases slightly only with the 1.33 litre version.

Try to get yourself a copy of the brochure for reference...................Toyota have carefully inserted some "*(Not applicable to 1.0)" in the brochure.

The salesman should have made it clear to you when you ordered the car.

Toyota also print a disclaimer at the back of the brochure "We reserve the right to change specifications, equipment and availability without prior notice....................For the latest specification we ask that you contact yor local Toyota Centre"

You may have some difficulty in persueing any legal claim against the dealer :(

the broschere i had was different also if you check here it clearly states you do get alloys..

if you have a broschere saying no alloys could you do me a favour and scan it for me please or find me the pdf were it states no alloys.thatd be a big help.

the broshure i had got thrown out a few weeks ago once we decided which car we wanted but i did get screen grabs and ive checked the toyota/dealerships website before i ordered and after and the specs have always been the same no change.

i know theres a disclaimer but surely they cant sell you a car with one spec and give you another without pointing out the facts what your losing..if id known about the drop in spec i wouldnt have had the tr id have stuck with the t and saved me alot of money because the spec ive got now too me doesnt justify the price increase .i do love the car it looks nice,good drive but i feel severly short changed and i blame toyota as much as the dealership for promoting the tr version as having lots of spec but only putting most of the toys on the higher priced tr the only difference i was told was the 1.33 had a bigger engine i was told all other spec was the same which isnt true.

ill double check the speaker thing but e could only find four ,the cd player does play mp3s which is good..

i was told alloys were only a option on the t2 version all other versions have individual looking wheels to show off the different car grades..i traded my old car in with the government scrappage deal when toyota annonced theyd give you 2750 of a new tr and too me it looks like to justify the extra money theyve taken things such as alloys of the spec without announcing it,which to me seems very dishonest and if the companys practising things like this there a dishonest company :(

There is some confusion with the TR trim, to be sure you get what the brochure says people should opt for the 1.33 engine. When the 1 litre is ordered and bought things tend to be missing. Even the Toyota staff are confused.

ive just found the brochere and downloaded it ..im gutted your right mate it does state trims not alloys but there website states different things it does state alloys .i think ill contact trading standards this week and see what they say now ..ill not send the letters to the dealership or take any further legal action until i check this out more too see legally how i stand when theres two things which conflict against each other and both advertise different things.

thanks again.i think ill post on here of any places that sell the chrome airvent rings ive tried searching but cant find anywere.

The online brochure that you linked to only shows 4 Speakers for the 1.0 litre TR :unsure: ...........(My printed Brochure states 6)

Copyright law prevents me from scanning in the brochure and posting it on the TOC forum. Maybe you could ask the dealer.........(OR ANOTHER DEALER or TOYOTA UK) for a copy.

If you cannot get a copy from a dealer of from Toyota UK I would be willing to post you my copy if you PM me your Name and Address............(DO NOT POST IT ON THE FORUM!)

It is such a shame that your buying experience has been tainted by these problems..................I wish you luck in resolving them :thumbsup:

You should be okay; Fair use rules mean you could scan that part in just for show (If you scanned in the whole thing then they'd have an excuse to set the lawyers on you, but for just a small part you should be okay. )

(That said, IANAL!)

The dealer does sound like they were a bit misleading 'tho; Borderline bait'n'switch type of thing...

Is there a cooling off period for cars, like with mail-order stuff? e.g. if you're unhappy with it you can return it within a certain period of time?

ive been in negotiations with toyota and the garage involved..and the problems been the fact nobodys 100 percent sure of the spec on the tr because it keeps getting changed and the magazine/broschere/dealerships are all getting fed different information..so whats happened is ive been to one garage got one spec and by the time its come to me buying and recieving it the specs been changed and now the specs changed again.

toyota gb have admitted it does need sorting out and even they are confused at what you should or shouldnt get but too say sorry theyve sorted me out some compensation its not a great compansation but weve both agreed they dont want it goto court and i dont want it too drag out for ages and in the end all ill get is a pair of wheels worth 500 pounds ..so weve come to a compromize and settled everything out between us and everyones happy now.. but it has put me off buying a new car again ill never do that ever again its not worth the hassle if i didnt get a good deal in the first place i would never have got one .

If I am going to spend £10,000+ on a car I would make dam sure I knew what I was buying and doing as much research as possible and checking the small print/on line/forums etc. Then I would check again.

So you now have your alloy wheels which in my opinion is a good result. Toyota has been very generous there. It could be argued that you should have stuck to your guns in the first place and got the T2 and all this wouldn’t have happened.

I would put it down to experience, now enjoy your new car!

no reece they didnt give me the alloys but i did know id win in court but i couldnt face the long time it would take to get something only worth 400 pounds and too be honest i saw them and they didnt look all that nice compared to other alloys i could buy next year from a proper alloy wheel store..i got extra optional trims for inside the car for free and i got the tr trims instead of the t2 trims id got. i know it doesnt exactlly get me the alloys but at least i got something and i dont have to drag it out threw the courts and theres always the chance id lose and if it came to that id be more broke than i am now .

i only actually paid 7750 for the car in the first place so all in all its not too bad for a 09 yaris tr ive seen 07 yaris go for more than i paid for a new one..and the car i scrapped in was only worth 200 pounds tops so not a bad deal really but i was a little clueless and none of my family or mates had ever bought a new car so it was a learning thing and ive realised if i ever did it again get everything in writting first and check the car threw out before paying for it .

When you say you got the optional trims for inside do you mean the chrome air vent surrounds?

yeah toyotas trying to source me the parts from were they make them ..the guy did explain it could take a while to get them but they would try and get me some and send them to the dealership as soon as they could.he said the problem is they dont make them in the uk and the places they make them useally get specific numbers made to make the same number of cars but they did say theyd try there best to get me those and he did say they just clip on no glue involved they just clip into the holes already exposed in the 1.0.

the problem is the magazine says you dont get them but the web site did say you get them same as the wheels the mag said trims website said alloys theres lots of conflicts thats why trading standards said id win it but there as small chance if i lost itd cost me a fortune they said best thing would be to negotiate some kind of deal that benifits everyone..so i didnt get the alloys but i have got other things i cant really say what i got because if others found out and complained theyd not got the same deal it might kick my deal in too touch.

i must say though toyotas customer services were excellent and the dealerships been good too weve all calmed down everyones appologised and everythings nice again now no more stress.

You would think Toyota would be a lot more on the ball when it comes to their own car specifications and models, regardless of how quickly those specs might change....after all do they want to sell cars or not???

I spoke to our dealership today and no-one actually knows what the TR stands for.

New cars come under the Sale of Goods Act. That means they must be "as described," "of satisfactory quality," and "fit for the purpose" - in this case, if you specify a specific need to the dealer, the car he sells you should be able to do that. If your car has a problem in the first six months, get the dealer to repair it (free of charge, of course) or replace it. Think twice before allowing a repair, since it could affect the resale value.

If you asked for a specific feature and the salesman said your car would have that feature then you have the right to reject the car. If the dealer is not being helpful then I would just reject the car can get a full refund. I know you have a good deal and it looks like things have been sorted to your satisfaction, it really depends how far you want to push the principal of being mislead by the salesman.

You would think Toyota would be a lot more on the ball when it comes to their own car specifications and models, regardless of how quickly those specs might change....after all do they want to sell cars or not???
When I got my Verso I rang Toyota Insurance for a quote the SR model was not listed so they had to just put in a T3 spec to give me a premium.

From all your other posts on this forum, I can't help but thinking this is a case of a 'bad workman blaming his tools'.

Unless toyota deliberately mis-sold you the car/spec then you don't have a leg to stand on.

As others have mentioned, you should have specifically checked what the car came with if it was such a big deal. If the dealer stated that your car would come with the added TR bits, then yes it would be a different story. If however you got confused with the specs and ended up buying a lesser spec car, I can't see how this is the dealers fault. Are they meant to idiot-check people who come into their showrooms...? Some people have no sense of responsibility.

Before I ordered my SR, I asked over and over for the supplying dealer to confirm what the car came with. The ball was firmly in their court, should they mess it up.

when i went to choose the car i went to various garages and the garages i went too all said the only difference was the engine i asked about what came with it one garage said all chrome bits except the handles,handbrake and i wouldnt get the quicker engine and advised me to get the 1.0 and save a little money but the price they wanted was pretty expensive so i shopped arouond double checked on the internet the cars spec and it did state no chrome handles but everything else was the same and alloys !! so then i shopped around got the best price and ordered it ..when it came i found out the spec had changed without notifiying the dealerships properly and even toyota gb has conflicting reports on what spec the trs have..

so i aint a idiot pal ..when i realised id been miss sold and toyota had misadvertised it i contacted trading standards who set up a case for me and said theyd contact me back within a few days once theyd got the broschure and got a print out of the website and sure enough they contacted me back and said your right the advertising does clearly conflict each other so in the eyes of the law you were missold a car because in both ads the specs are different so if toyota said we only go of the spec from the internet then the book was wrong they said toyota couldnt say one was correct without proving the others missleading.so in the courts id win but they did explain itd get dragged out and its quicker and less hassle to come to a compromise which both partys will be happy so thats what i did ..both toyota and the dealership i bought the car from have now admitted the advertising needs reprinting because the specs are wrong and the tr specs have changed again since i got my car 4 weeks ago ..you now get less airbags in all tr models ordered now you also only get 2500 pounds government trade in on a tr but you do get alloys now so the garage has said its better to get the extra air bags than get alloys because its cheaper to buy alloys later than buy airbags and get them fitted which would cost a fortune.

im also going threw the new car owner syndrome were im trying to be as careful as i can but everytime it sems like everythings out too get me lol...i do like the yaris thats why ive kept it and after calming down im just gonna try and get on with it and start enjoying the car instead of worrying about it..and my wifes promised to buy me some alloys for the car for xmas so im a happy bunny now :)
